## 1. Acceptance of Terms
By creating an account, installing the GenFlik Shopify App, or otherwise using GenFlik ("the Service"), you agree to be bound by these Terms of Service. These Terms cover the GenFlik web app at genflik.com, the GenFlik mobile app, and the GenFlik Shopify App installed from the Shopify App Store. If you do not agree, do not use the Service.
GenFlik is an AI-powered video generation platform that helps merchants and creators produce talking-avatar marketing videos using AI avatars, voice synthesis, and script generation. The Shopify App connects to a merchant's Shopify store to read product information and (optionally) sanitized product reviews to inform ad scripts.
GenFlik operates on a prepaid credit system. Each video generation deducts credits based on the tier, length, and any add-ons. The cost is shown before each render.
**Web and mobile payments:** - Credit packs on the web and mobile apps are purchased through Stripe - Apple App Store and Google Play in-app purchases are subject to Apple's and Google's respective terms - Refunds for App Store or Google Play purchases must be requested through Apple or Google
**Shopify App Store payments:** - Merchants who install GenFlik from the Shopify App Store pay through Shopify's Billing API - Shopify is the merchant of record; refunds follow Shopify's policies - Pricing is identical across all payment methods
**General:** - Credits are non-refundable once consumed - Unused credits expire 24 months after purchase - Failed renders caused by our system are automatically refunded to your credit balance - Prices may change with 30 days' notice; existing credit balances are unaffected
You agree NOT to use the Service to: - Create content that is illegal, fraudulent, harmful, threatening, abusive, or defamatory - Generate content depicting real, identifiable people (including public figures) without their written consent - Create sexually explicit, pornographic, or suggestive content, or anything depicting minors in such contexts - Impersonate any person or entity, or clone a voice without the voice owner's explicit consent - Promote hate, violence, self-harm, terrorism, or illegal goods - Falsely claim medical, financial, or legal outcomes - Reverse-engineer, decompile, or scrape the Service - Bypass rate limits, billing checks, or admin restrictions - Violate the policies of any platform where you intend to publish the generated content
Optional marketing reuse:
When you create a video, you may tick an optional "feature this video" checkbox. If and only if you tick that box, you grant GenFlik a non-exclusive, revocable, royalty-free license to display, reproduce, and distribute that specific video on GenFlik's own marketing channels (including the GenFlik website, social media accounts, sample reels, and advertising). This is a permission, not an obligation — GenFlik may feature any, all, or none of the videos you opt in. You may revoke this license for any future use at any time by toggling the setting in your account; videos already published by GenFlik under a prior opt-in may remain published. Marketing reuse is never offered for videos that use a custom avatar (your own likeness or a third-party likeness), because we do not have rights to the depicted person for our own marketing.
If you install GenFlik through the Shopify App Store: - You authorize us to access your store's products, listings, reviews, and aggregate order counts as described in our Privacy Policy - The OAuth access token issued by Shopify is used solely to operate the features you enable inside the embedded admin - We will immediately stop accessing your store's data on uninstall and hard-delete your record within 48 hours per Shopify's shop redact webhook - Use of the embedded admin is additionally governed by Shopify's API License and Terms of Use
The Service integrates with third-party providers listed in our Privacy Policy. We are not responsible for outages, errors, or policy changes by those providers. If a provider goes down, affected renders are refunded in credits, but we make no guarantee of uninterrupted service.
THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We make no guarantee that generated videos will achieve any particular sales outcome, or that generated content will be free of factual errors or awkward phrasing. You are solely responsible for reviewing generated content before publishing it.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENFLIK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY ARISING OUT OF THE SERVICE IS LIMITED TO THE GREATER OF AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR USD ONE HUNDRED DOLLARS.
You agree to defend and hold GenFlik harmless from any claim arising from your content, your use of generated content, your violation of these Terms, or your infringement of any third party's rights (including likeness, voice, copyright, or trademark).
You may stop using the Service and delete your account at any time. We may suspend or terminate your access for any violation of these Terms, for non-payment, or in response to a legal request. On termination, your access ends immediately, generated content you already downloaded remains yours, and unused credits are forfeited unless we terminate without cause.
These Terms are governed by the laws of the State of Delaware, USA. Disputes will be resolved in the state or federal courts in Delaware. If you are a consumer in the EEA or UK, this clause does not affect your rights under mandatory local consumer law.
We may update these Terms from time to time. Material changes will be announced by email and by updating the Last Updated date. Continued use after notice constitutes acceptance.
